The short answer
DCSA's report published on 25 May 2024 examined electronic-bill-of-lading barriers in 15 countries representing, by its account, 60% of global trade. The operational conclusion is that an eBL is not a scanned paper bill. It needs a legal framework that recognizes electronic transferable records, trusted identities and signatures, control over the authoritative record, interoperable data and a fallback agreed by every party in the transaction.
Digital adoption begins with the legal effect of the document
A bill of lading can serve as a receipt, evidence of the contract of carriage and, when issued in negotiable form, a document of title. Replacing paper therefore requires more than faster messaging. The electronic record must be capable of performing the relevant legal functions in the jurisdictions and transaction concerned. DCSA's report focused on legal and regulatory frameworks because inconsistent recognition remains a barrier to global use. A shipper should ask counsel, the carrier and any bank whether the chosen eBL system is accepted for the route, financing structure and document type. The answer may differ for a non-negotiable sea waybill, a straight bill and a negotiable original. Technology selection should follow the legal use case.
There must be one authoritative record and a clear holder
Paper creates physical possession of an original; an electronic system needs a reliable equivalent for exclusive control. Users must know which record is authoritative, who controls it now, how that control transfers and how an amendment or surrender is recorded. Emailing a PDF to several parties does not solve those questions and can increase fraud risk. Before a live shipment, map issuance, transfer, endorsement where applicable, surrender and cancellation. Confirm the system's audit trail and what evidence can be produced in a dispute. The workflow should prevent two parties from appearing to hold the same original. This is the core difference between digitizing the appearance of a bill and digitizing its legal function.
Identity and signing authority are operating controls
Every eBL handoff depends on knowing which legal entity and authorized person or system is acting. Supplier trading names, buyer subsidiaries, freight agents and banks can be confused when master data is weak. Establish the legal company record, user roles and approval limits before issuance. Use secure access and protect recovery processes with the same seriousness as payment controls. If a staff member leaves or a device is compromised, the business needs a defined way to revoke access without losing control of a live title document. Digital identity can reduce manual checking, but only when onboarding and governance are strong. A bad identity entered faster is still a bad transaction.
Interoperability determines whether data keeps moving
DCSA's wider digital trade work seeks standard data and processes across carriers and platforms. That matters because a container journey can involve a shipper, forwarder, carrier, customs authority, bank, insurer and consignee using different systems. If each connection requires re-keying a PDF, the transaction remains partly manual and errors persist. Structured data should carry consistent names, cargo descriptions, package counts, weights, dates and references between systems while preserving the authoritative record. Adoption teams should test the whole chain, not only successful issuance on the carrier portal. Ask which parties can receive, transfer and surrender the document and which data must still be entered again. Integration gaps belong in the operating plan.
Trade finance can be the decisive dependency
A bank handling a letter of credit may require precise presentation rules, timing and document examination. An eBL platform that works for carrier release may not automatically satisfy the financing bank or counterparty. Bring banks into the design before the first shipment, and confirm the electronic presentation channel, document format, discrepancy process and contingency if a party cannot receive the record. Align the sales contract and letter-of-credit terms with the intended electronic workflow. Do not switch formats after issuance without understanding the legal and banking effect. The potential speed gain is substantial when parties are aligned; the delay can be worse than paper when they discover incompatibility after the vessel has sailed.
Pilot a boring, repeatable lane first
Choose a regular trade with known counterparties, a supportive carrier and no unusual financing or title transfer. Write acceptance criteria: correct issuance data, successful transfer, bank or consignee acceptance where relevant, timely surrender, cargo release and a complete audit trail. Run a tabletop failure before the live shipment. What happens if the platform is unavailable, the recipient identity is wrong or a jurisdiction requires paper? Agree who can trigger the fallback and how duplicate originals are prevented. After several successful shipments, expand by counterparty and corridor. DCSA described momentum toward carrier commitments for full eBL adoption by 2030; businesses will reach usable adoption through controlled transactions rather than a one-day paper switch-off.
